Welcome to Fuel to Lose. These Terms of Use ("Terms") govern your access to and use of the Fuel to Lose mobile application (the "App") and any related services provided by Fuel to Lose ("we," "us," or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not use the App.
You must be at least 13 years of age to use Fuel to Lose. By using the App, you represent and warrant that you meet this age requirement. If you are between 13 and 17 years of age, you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
You must provide accurate and complete information when creating an account and keep your account information up to date.
Fuel to Lose is offered on a subscription basis. Access to the App's full features requires an active paid subscription.
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current subscription period.
The price of your subscription is displayed at the time of purchase in the App. Prices are in your local currency and include all applicable taxes. We reserve the right to change subscription pricing. Any price changes will be communicated in advance and will take effect at your next renewal.
All billing is handled by Apple through the App Store. You authorize Apple to charge your Apple ID account the applicable subscription fee on a recurring basis. We do not have access to your payment card details.
We may offer a free trial period for new subscribers. If a free trial is offered, it will be clearly stated at the time of sign-up. At the end of the free trial period, your subscription will automatically convert to a paid subscription and your Apple ID account will be charged unless you cancel before the trial ends.
Free trials are available to new subscribers only. We reserve the right to determine eligibility for free trials at our discretion.
You may cancel your subscription at any time through the App Store on your device:
Cancellation takes effect at the end of the current billing period. You will retain access to the App until that date.
All subscription purchases are processed by Apple. Refund requests must be submitted directly to Apple in accordance with Apple's refund policy. We do not have the ability to issue refunds for App Store purchases. To request a refund, visit reportaproblem.apple.com.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

Fuel to Lose is not a medical application and does not provide medical advice. The workout plans, nutrition guidance, calorie and macro calculations, and all other content provided through the App are for general informational and wellness purposes only.
The information provided by the App is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider before beginning any exercise program or making changes to your diet, especially if you have any pre-existing medical conditions, injuries, or health concerns.
By using the App, you acknowledge that:
The App and all of its content, features, and functionality — including but not limited to text, graphics, logos, workout programs, exercise descriptions, videos, and software — are owned by Fuel to Lose and are protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App solely for your personal, non-commercial use. This license does not include the right to reproduce, distribute, modify, create derivative works, publicly display, or otherwise exploit any content from the App.
The App allows you to input and store personal data such as food logs, workout records, progress photos, and body measurements ("User Content"). You retain ownership of your User Content.
By submitting User Content to the App, you grant us a limited license to store, process, and display that content solely for the purpose of providing the App's services to you. We do not claim ownership of your User Content and will not use it for any other purpose without your consent.
You are solely responsible for the accuracy of the User Content you submit. We are not responsible for any inaccuracies in nutrition data, calorie counts, or other information you enter.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.
You agree to defend, indemnify, and hold harmless Fuel to Lose and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of a third party.
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion.
You may stop using the App at any time. To delete your account and associated data, go to Settings → Account → Delete Account within the App, or contact us at [email protected].
Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and governing law) will remain in effect.
These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or your use of the App shall be resolved exclusively in the courts located in the United States.
If you are a consumer in the European Union, you may also have rights under the laws of your country of residence.
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page and notify you via a push notification or in-app notice. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
